Kastell’s public procurement team is made up of some of Sweden’s leading lawyers in this area. We provide legal advice on all aspects of public procurement. Public procurement-related litigation

It is our conviction that success in public procurement-related litigation requires expertise in both public procurement law, and dispute resolution. Kastell’s public procurement team combines extensive knowledge of the substantive procurement rules with expertise in dispute resolution. This makes the team unique. We represent clients in all types of procurement cases:

  • Administrative procedure – Review of procurement processes and validity of agreements: our team has advised on well over 100 procurement cases, many of which many have been large and complex procurement processes, across virtually all sectors.
  • Civil Procedure – Disputes regarding damages under the public procurement rules and contract disputes relating to public procurement: Kastell’s extensive dispute resolution experience means that the team is regularly instructed on matters relating to damages resulting from infringement of the procurement rules. Kastell’s lawyers are also regularly instructed in disputes involving the interpretation and implementation of agreements entered into following a public procurement.
Procurement procedure

We have extensive experience of assisting both public authorities and suppliers in connection with procurement processes, including some of the most complex procurement processes in Sweden:

 

  • On the entity side we assist by, inter alia, producing procurement documents, including draft agreements, providing support in negotiations etc.

 

  • On the supplier side, we provide risk analyses, review specifications and offers, advise on negotiations, etc.

 

Our team can act as a legal sounding board throughout the procedure, or we can take on a more active role, depending on the client’s preference. We always aim to be a proactive part of the procurement procedure as a whole, and to contribute to maximising our clients’ chances of achieving the best deal possible.
